§ 2 Scope

These general terms and conditions apply to all legal transactions betweenUser and a consumer
(According to § 13 BGB a “natural person who aConcludes legal transaction for purposes that are predominantly neither commercial norcan be attributed to their independent professional activity ”).

§ 3 Conclusion of the contract and storage of the contract text

The provisions of these terms and conditions apply to orders placed by consumers via theWebsite www.ant-elephant.de
of the online shop.
The contract is concluded with the user (see § 1).
The contract language is German.
With the presentation and description of the goods on the website of The Ant & Elephant Storewww.ant-elephant.de we will make you a binding offer to conclude a contract under the conditions specified in the item description.
With the order of goods by clicking on the button “order for a fee” onAt the end of the ordering process, a consumer makes a binding offer for aConclusion of the purchase contract.
Only when an order confirmation is sent by emailthe contract is concluded for the user.
The text of the contract is not saved by us when ordering. Consumers will receive an email withthe order details and the applicable terms and conditions. After the conclusion of the contract, the order data is notmore available online.
In the case of requests for offers outside of the online shopping cart system, you will receive all contract data as part of a binding offer in text form, e.g. by e-mail, which you can print out or save electronically.

§ 4 Payment and Payment Methods

The prices listed in the respective offers as well as the shipping costs represent total prices. They include all price components including all taxes.

The shipping costs are not included in the purchase price. They can be called up via a correspondingly labeled button on our website or in the respective offer, are shown separately in the course of the ordering process and are to be borne by you in addition, unless free delivery has been promised.

If the delivery is made to countries outside the European Union, we may incur additional costs for which we are not responsible, such as customs duties, taxes or money transfer fees (transfer or exchange rate fees of the banks), which you must bear.

Any costs incurred for the transfer of money (transfer or exchange rate fees of the credit institutions) are to be borne by you in cases in which the delivery is made to an EU member state, but the payment has been initiated outside the European Union.

The payment methods available to you are shown under a correspondingly labeled button on our website or in the respective offer.

Unless otherwise stated for the individual payment methods, the payment claims from the concluded contract are due for payment immediately.

§ 5 delivery, delivery restrictions

The delivery conditions, the delivery date and any existing delivery restrictions can be found under a corresponding button on our website or in the respective offer.

As far as you are a consumer, it is regulated by law that the risk of accidental loss and accidental deterioration of the item sold during shipment is only transferred to you when the goods are handed over, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company not named by the entrepreneur or a person otherwise appointed to carry out the shipment.

§ 6 Transfer of Risk

The risk of accidental deterioration or accidental loss of the goods is up tofor handing over the goods to the user and the handover to the consumerabove.

§ 7 retention of title

The user retains ownership until the purchase price has been received in fullof the goods.

§ 8 Warranty

The statutory warranty rights apply.

As a consumer, you are requested to check the item for completeness, obvious defects and transport damage immediately upon delivery and to notify us and the carrier of any complaints as soon as possible. If you fail to do so, this has no effect on your statutory warranty claims.

§ 9 Choice of law

German law applies. For consumers, this choice of law only applies insofar as this does not remove the protection granted by mandatory provisions of the law of the state in which the consumer is habitually resident (favourability principle).

The provisions of the UN sales law expressly do not apply.
